Welcome to all4five! We are a unique concept for marketplace web site, portal where sellers can meet buyers and offer their products with a fixed price of $5 USD. all4five acts as marketplace venue, to allow users (buyers and sellers) to offer items, buy and sell a deliverable item.

However, in order to sell or buy items, and provide you "order tracking" services, you must register on the Site ("Registration") to use our Services. During Registration You will be asked to provide information such as your name, address and email address. You will also be asked to create an account consisting of a User ID and password ("Your Account") to identify yourself in future visits to the Site. It is YOUR responsibility to maintain the confidentiality of Your User ID and password and you agree to accept responsibility for all activities that occur under Your Account. You may not transfer, assign or sell Your Account (including rating and feedback) to any third party.

User Information

You represent and warrant that Your User Information (i) is not false, inaccurate, incomplete or misleading; (ii) is not fraudulent and does not involve the sale of counterfeit or stolen items; (iii) does not infringe any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (iv) does not violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (v) is not defamatory, libelous, unlawfully threatening or unlawfully harassing; (vi) is not obscene and does not contain child pornography; (vii) does not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (viii) does not create liability for all4five nor cause all4five to lose (in whole or in part) the services of our ISPs or other suppliers; and (ix) does not link directly or indirectly to another web site. Furthermore, You may not list any item on our Site (or consummate any transaction that was initiated using our Service) that, by paying to us the listing fee or the final value fee, could cause us to violate any applicable law, statute, ordinance or regulation, or that violates our current listing restrictions. You agree not to make use of any other user’s User Information other than as necessary to complete any transactions in which You and the subject of the User Information are involved.

Selling product

You must have the legal authority to sell the goods that You are listing for sale on our Site. You must describe Your item and all terms of sale in Your listing. If buyer buy your item, You are obligated to complete the transaction with the other party and deliver the item as describe in your listing, according to shipment terms or return policy. Failing to deliver the item, seller must immediate rebate the buyer, including commissions fees.

Buying products

Buying: If you use "buy now" procedure, You are obligated to complete the transaction with the other party and to be bound by the terms and conditions specified by the seller, unless (i) the transaction is prohibited by law or this Agreement, (ii) the seller materially changes the item’s description or the item does not conform to the seller’s description, or (iii) a typographical error exists in the listing information which materially affects the terms of sale.

Payments

Items price is always presented in US dollars and always equivalent to $5 USD per item. Price is always includes shipment to customer, however does not include local taxes and customs fees. Seller may limit the shipment destination for specific predefined countries.

Buyer can pay via Paypal using the following 2 options:

* Using buyer Paypal account

* Credit cards (e.g. Visa, MasterCard, American Express etc.) via Paypal. Buyer doesn’t have to register to Paypal.

Customers bank information and credit card number are never passed to the seller or to all4five marketplace. Information is handled only directly with Paypal.

Shipment

Shipment is always free of charge and included on the item $5 USD price. Seller is not allowed charge the buyer for additional shipment costs.

Seller may limit the countries where the products can be shipped. Seller must inform the buyer (on product listing) the countries included or excluded on shipping destinations.

System will not block buyers that are not on the country shipping list, assuming buyer would like to send item to another address.

Handling orders

Tax and Local duties: ITEMS PRICE DOES NEVER INCLUDE LOCAL TAXES AND CUSTOMS FEES. BUYER SHOULD PAY ALL APPLICABLE LOCAL TAXES AND CUSTOMS.

Buyer protection – seller feedbacks

Seller feedbacks - Safe Trading:

Because user authentication on the Internet is difficult, all4five cannot and does not confirm each user’s purported identity. Thus, we have established a feedback system to help You evaluate the user with whom You are dealing. We also encourage You to communicate directly with potential buyers or sellers through the features available on our Site.

Seller feedback is calculated as following:

* Number of total feedbacks: including the positive and negative feedbacks.

* Percentage of positive feedbacks: calculated total of positive feedback divided to overall feedbacks

Seller may copy his "ebay" feedback (after manual validation of all4five admin), that include number of feedbacks and percentage of positive feedback.

Fees

Unless otherwise stated, all fees are quoted in U.S. Dollars.

Registration:

Registration to all4five is free both for buyers and sellers.

Insertion of Items fees

Insertion of Items (listing and Item) is free of charge. Each item remains listed for 60 days from Item Insertion.Seller can extend the listing of an item, each time for extra 30 days. Extending the lasting of an item is free of charge.

Selling an Item:

Each time when a seller is selling an item and receive the payment, 5% fees ($0.25 USD) will be automatically transferred from seller PayPal account to all4five marketplace account (for more information, please refer to PayPal Chained Payment)

Currency Converting:

All fees and items on all4five are listed in US Dollars. Currency conversion is handled automatically by PayPal payment processing.

You agree that You are responsible for paying all fees, including any and all applicable sales, income, excise, import, export, VAT and other taxes or duties associated with using our Service and the Site.

We reserve the right to change or discontinue, temporarily or permanently, some or all of our Services at any time with or without notice. In the event we introduce a new service, the fees for that service are effective at the launch of the service. We may also choose to temporarily lower the fees for our Services for promotional events (for example, free listing days), and such changes are effective when we post information about the promotional event on the Site. Additionally, we may change our Fee Policy and the fees for our Services at any time and in our sole discretion. Except for the foregoing fee changes, our changes to the Fees Policy are effective after we post the changes on our Announcement Board.

Resolution and dispute

We encourage our buyers and sellers to resolve any issues between themselves. If for any reason this fails, you can contact us at “contact-us” section.

all4five, for the benefit of users, may try to help users resolve disputes. all4five does so in all4five sole discretion, and all4five has no obligation to resolve disputes between users or between users and outside parties. To the extent that all4five attempts to resolve a dispute, all4five will do so in good faith based solely on all4five policies. all4five will not make judgments regarding legal issues or claims.

Should you have a dispute with one or more users, or an outside party, you release all4five (and all4five officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. all4five encourages users to report user-to-user disputes to your local law enforcement, postmaster general, or a certified mediation or arbitration entity, as applicable.

all4five, and other all4five graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of all4five. all4five's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.

Liability

Our Site acts as an open marketplace for users to buy and sale of goods with other users. all4five only provides a service and is not involved in any transaction between buyers and sellers who use our Site. There are risks that you assume when dealing with foreign nationals or those who may be acting under false pretenses. You agree that all of these risks are borne by You, and not all4five. all4five does not control the behavior of users on the Site or the information provided by other users that is made available through our Site. As a result, all4five does not guarantee or endorse the authenticity, quality, safety, or legality of any items offered or sold, the truth or accuracy of any listings, or the ability of sellers to sell items or of buyers to buy items. We cannot assure that all transactions will be completed. You can always opt-out of receiving any information from us, but please understand that such a request will likely limit your ability to take advantage of all of the features and services available on all4five.
